Marissa Boyd is an experienced litigator who supports the firm’s employment, intellectual property, and business litigation practices.  Marissa has represented clients in a variety of commercial litigation contexts, including wage and hour class actions, trademark prosecution and brand protection, construction defects, breach of contract and other business disputes, software and copyright infringement, and pre-litigation counseling.  Her practice includes complex federal and California state court litigation, mediation, and arbitration.  Marissa is a committed advocate and dedicated advisor for all her clients, which have ranged from fledgling start-ups and small non-profits to large multinational Fortune 100 companies.

 

Marissa earned her J.D. from the University of California, Berkeley School of Law, Order of the Coif, where she received a certificate in Intellectual Property & Technology.  While at Berkeley, Marissa served as a judicial extern to the Honorable Jon S. Tigar in the Northern District of California and as an Associate Editor for the California Law Review.  Marissa has also been recognized as a Super Lawyer Rising Star in Northern California in 2024.  Only 5% of attorneys in Northern California receive this distinction.

Representative Matters

  • Provided litigation assistance in multi-party real estate, breach of contract, and construction defect lawsuits, including reviewing documents, helping defend clients in depositions, and drafting motions to obtain favorable judgement and settlements.

  • Participated in wage-and-hour class action litigation, including reviewing documents for production, preparing for depositions, analyzing claims and defenses, responding to discovery requests, and opposing class certification.

  • Represented large tech companies in copyright, patent, and trademark disputes, including researching and writing legal memoranda, responding to discovery requests, and drafting motions.

  • Helped resolve breach of contract business litigation disputes, including drafting summary adjudication motions and assisting with collection on judgments owed to clients.

  • Provided brand counseling and trademark prosecution advice, including trademark search clearance analysis, drafting office action responses, and negotiating with USPTO trademark examiners regarding the scope of trademark applications.

  • Negotiated and drafted settlement and co-existence agreements on favorable terms for clients.

  • Counseled clients through pre-suit strategic planning considerations in start-up, founder, trade secret, and software disputes, including researching and analyzing potential claims and drafting cease and desist letters.
