Brandon V. Stracener

Brandon focuses on the best solution at all times for his clients, whether that is effective pre-litigation negotiation, mediation, arbitration, or litigation in state or federal court. He has experience in all means of resolving legal disputes, including trial experience and writ and appellate experience before state and federal appellate courts. He represents individuals and companies at various stages in their life cycle in an array of disputes, including data privacy, trade secrets, trademark, copyright, and real estate litigation. Brandon’s recent successes include securing a judgment exceeding $1 million, obtaining a full grant of a preliminary injunction shortly after filing suit, filing an amicus brief for the winning party before the Ninth Circuit, and obtaining all of a client’s requested relief through pre-litigation negotiation—without the need for a lawsuit. He has experience with matters ranging from small to large, including obtaining denial of a preliminary injunction that would have halted a multimillion-dollar partial asset sale—preserving hundreds of jobs as part of that sale—and trial of lawsuits for asserted damages reaching the nine-figure mark.

 

As an author of several publications on constitutional law issues, including California constitutional law, Brandon has become a resource for media comment and interviews throughout the state for insight on a variety of legal topics. His work has appeared in the San Francisco Chronicle, the Los Angeles & San Francisco Daily Journal, an Icelandic newspaper, multiple law journals, and on law.com. He contributes often to SCOCAblog, covering the California Supreme Court, and he maintains a role as Senior Research Fellow at the California Constitution Center.

 

Brandon’s familiarity with the courtroom is rooted in his past experiences working for judges at several courts. He served as a law clerk for the Honorable Kimberly J. Mueller, District Judge at the U.S. District Court for the Eastern District of California, and the Honorable Lucy H. Koh, District Judge at the U.S. District Court for the Northern District of California. Brandon also externed for the Honorable Consuelo María Callahan, Circuit Judge at the U.S. Court of Appeals for the Ninth Circuit, and the Honorable Mariano-Florentino Cuéllar, Associate Justice of the Supreme Court of California.

 

Recognizing the importance of effective written advocacy, Brandon shares his insights as a Lecturer in Advanced Legal Writing at the University of California, Berkeley School of Law. There, he promotes clear, brief, and powerful writing that actually persuades the decisionmakers in a given matter.

Experience and Education:

Before joining Brown, Gee & Wenger LLP, Brandon was an Associate at Cooley LLP in Palo Alto, California, where he represented several clients working on innovative technology and facing complex legal questions every day. He has clerked for the Honorable Kimberly J. Mueller, District Judge at the U.S. District Court for the Eastern District of California, and the Honorable Lucy H. Koh, District Judge at the U.S. District Court for the Northern District of California. He externed for the Honorable Consuelo María Callahan, Circuit Judge at the U.S. Court of Appeals for the Ninth Circuit, and the Honorable Mariano-Florentino Cuéllar, Associate Justice of the Supreme Court of California.

 

Brandon received his JD from the University of California, Berkeley School of Law and his BA in Philosophy from the University of California, Berkeley. During his first year of law school, Brandon earned the Dean’s Award for best performance in Contracts in his section. He also received a Jurisprudence Award (highest rank) in the course Habeas Corpus & the Death Penalty as taught by the Honorable William A. Fletcher, Circuit Judge at the US Court of Appeals, Ninth Circuit. Brandon performed well in multiple moot court competitions, including obtaining the best brief score for his party in one regional competition and receiving an award for best oral argument for the region in another. Brandon also served as the senior development editor and on the executive committee of the California Law Review during his time as a student at Berkeley Law. As part of his final year of law school, he led a student team comprising Berkeley Law and UC Davis Law students in revising California’s Political Reform Act.
